PRIVACY STATEMENT

Bermuda Offshore Investment Services Limited (“BOIS”) has always been committed to protecting the privacy of personal information that we collect and maintain in the course of carrying on our business. This document describes how we collect, hold, use, and disclose your personal information.

  1. We hold the personal information we collect about you (and your spouse and/or beneficiary as applicable) in a record called the “client file”. Depending on the investment or service you request, the personal information in your client file may include:
    1. your contact details, such as name, address, telephone number, e-mail address
    2. tax identification number (“TIN”)
    3. birth date/place of birth
    4. marital status
    5. emergency/alternate contact information
    6. bank account, business, employment and professional details
    7. investment preferences, risk appetite and goals
    8. copies of identification documentation
    9. account holdings
    10. contact details, and TIN of your spouse and/or beneficiary.
  2. Location of Personal Information: Your personal information is kept in electronic, or paper format primarily in Bermuda, but it may also be kept in other locations for security or business purposes. BOIS has appropriate technical and organisational measures in place to prevent the unauthorised or unlawful use of your personal information, and accidental loss or destruction of, or damage to, your personal information.
  3. Collecting, Holding, Using, and Disclosing Personal Information: BOIS may collect, hold, and use the personal information in your client file as well as collect personal information from and disclose personal information to the third parties for the following purposes:
    1. identifying you and ensuring the accuracy of information contained in your client file;
    2. establishing and administering your account, determining, maintaining, recording, and storing account holdings and transaction information in your client file;
    3. executing transactions including transferring funds by electronic or other means;
    4. providing you with account statements, transaction confirmations, and other information which you may request as needed to service your account;
    5. meeting legal and regulatory requirements.
  4. Third Parties: We may have to share your data with third parties, including third-party service providers and investment product companies. We expect third parties to provide a level of security at or above the level of our protection of your data.
  5. You are entitled to access, through a written request, the personal information contained in your client file. You may verify this personal information and request that any inaccurate information be corrected. You may make such a request to info@bois.bm, Attn: Privacy Officer.
  6. You are also permitted to ask for your data to be erased, subject to limited exceptions set out in law, such as regulatory Financial Crime data. Should data be erased, a formal confirmation is provided to you. You may make such a request to info@bois.bm, Attn: Privacy Officer.
  7. We will not keep your personal information for longer than is necessary for our purposes, with a minimum set out by the Investment Business (Client Money) Regulations and Proceeds of Crim (Anti-Money Laundering and Anti-Terrorist Financing) Regulations.

Open an Account

Accounts may not be opened for individuals who hold a US Passport or have a US Address.

Bermuda Offshore Investment Services Limited is licenced and regulated by the Bermuda Monetary Authority. All client accounts are subject to stringent identity requirements as outlined in the Bermuda Government Proceeds of Crime Act 1997, Proceeds of Crime (Money Laundering) Regulations 1998, and the Guidance Notes on the Prevention of Money Laundering. Additional information may be obtained from the “National Anti-Money Laundering Committee” website. Bermuda is a member of the Caribbean Financial Task Force (CFATF) which is the first regional grouping of the Financial Action Task Force (FATF or GAFI).

The following documentation is required for all accounts. The certification or date of all documents must be less than three months old.

Personal Accounts

  1. Account Agreement
  2. Account Application
  3. Notarized or Certified copy of the Passport for each beneficial owner of the account (cannot be a US Passport)
  4. Notarized or Certified copy of one additional piece of identification bearing a photograph for each beneficial owner of the account (National identity card, drivers licence, etc.)
  5. Original or certified copy of two of the following showing the residential address of the Account Holder (cannot be a US address): utility bill, bank statement, land tax statement, household or motor insurance statement
  6. Additional documentation may be required including Letters of Reference.

Corporate Accounts

  1. Account Application
  2. Account Agreement
  3. Notarized or Certified copy of Certificate of Incorporation
  4. Notarized or Certified copy of the Memorandum and Articles of Association
  5. A list of the names, ocupations, dates of birth, and residential and business addresses of all directors and any shareholders holding more than 10% of the issued shares
  6. Corporate resolution to open the account , listing the officers authorized to sign on the account
  7. Notarized or Certified copy of the Passport for each officer authorized to sign on the account (cannot be a US Passport)
  8. Notarized or Certified copy of one additional piece of identification bearing a photograph for each officer authorized to sign on the account (National identity card, drivers licence, etc.)
  9. Originals or certified copy of two of the following showing the residential address for each officer authorized to sign on the account (cannot be a US address): utility bill, bank statement, land tax statement, household or motor insurance statement
  10. Additional documentation may be required including Letters of Reference.

Account Details

Bermuda Offshore Investment Services acts solely as an advisor and broker, processing all purchases directly to the investment vehicles selected by the client. Each mutual fund company in which an investment is placed will open an account registered in the name as instructed by the client, and assign a unique account number to the client. Investments and accounts may be registered in the client name, or if the client prefers, in nominee, trust, or in a corporation’s name. Nominee, trust and corporate services are available from a variety of sources.

All invested funds are registered and accounted for on an individual client basis. All transactions require the express approval of the authorized signing officers for the account. Bermuda Offshore Investment Services and each individual mutual fund company will separately issue confirmations of each investment placed with them, and send them by mail directly to the registered account holder at the address specified by the client. Each individual mutual fund company issues quarterly or semi-annual statements for each client, which are mailed directly to the registered account holder at the address specified by the client. Bermuda Offshore Investment Services also provides quarterly consolidated statements for each client.

Purchases and redemptions may be made at any time, and there is no restriction, contract or limit on the length of time the funds have to remain invested.

Our Management Team

Matthew J. Cairney, FICB

As Managing Director, Mr. Matthew J. Cairney brings to Bermuda Offshore Investment Services over 30 years of extensive experience in the Financial Services Industry in Canada and Bermuda. He was employed by the Royal Bank of Canada for 13 years, and was active in the promotion of the Royal Bank’s retail investment products including fixed income securities and mutual funds. In Bermuda, Mr. Cairney has worked with the Bank of Butterfield, and as an independent Management Consultant.

John Barnett, CFP, CLU

Mr. Barnett has been involved in the financial services industry since 1969. Following a very successful 33 year career with Sun Life of Canada, he formed a company in Bermuda to distribute life insurance and annuity policies to high net worth individuals around the world. Mr. Barnett has held senior positions in both Bermuda and Canada in financial services industry associations.

Ben M. Cairney, BSc,CFP, CIP, CRM

Mr. Ben Cairney has been working with Bermuda Offshore Investment Services since 2008. Prior to this Mr. Cairney accumulated 5 years of experience in the corporate insurance and risk management field. He has a Bachelor of Science degree from the University of Calgary in Mathematics-Actuarial Science and holds designations as a Certified Financial Planner (CFP), Chartered Insurance Professional (CIP) and in Canadian Risk Management (CRM).

The result: Our investment philosophy is to create an investment portfolio that will meet your unique objectives, while maintaining an acceptable risk exposure. This requires balancing the opportunities for return with the potential for reduction of risk through asset allocation.
